本《軟體最終使用者授權合約》（以下簡稱「本合約」）係由使用者（個人、科技媒體、研究機構或單一法人實體，以下統稱「使用者」）與安容科技股份有限公司（以下簡稱「本公司」）就使用「AnroMark 地端 AI 算力評測工具」（以下簡稱「本軟體」）所訂立之合約。當使用者點選「我同意」、「接受」、勾選確認方塊，或於閱讀本合約後進行安裝、註冊、複製、下載、或執行本軟體時，即表示使用者已閱讀、理解並同意受本合約之約束。若使用者不同意本合約之內容，請勿安裝、啟用或使用本軟體，並應停止安裝程序或刪除已安裝之本軟體及相關檔案。如使用者係代表法人、公司、機構或其他組織使用本軟體，使用者聲明並保證其具有代表該法人、公司、機構或組織接受本合約之權限。本軟體係由本公司自臺灣提供，僅以臺灣地區之使用者為對象，未針對任何其他國家或地區進行行銷或在地化。使用者如於臺灣以外地區使用本軟體，應自行確認其使用之合法性，並自行承擔相關風險。本軟體僅提供予年滿十八歲之使用者。使用者於點選「我同意」、註冊帳號或使用本軟體時，即聲明並保證其已年滿十八歲，且係於臺灣地區使用本軟體。未滿十八歲者，請勿安裝、註冊或使用本軟體。
第一條 標的與授權
1.1 定義與來源：
- 1.1.1 本合約所稱「本軟體」，係指由本公司開發、發行或提供之 AnroMark 軟體及相關內容，包括但不限於硬體基準測試模組、系統壓力負載組件、演算法跑分腳本、相關圖形使用者介面、帳號/顯示名稱設定機制、隨附之離線或線上說明文件，以及後續釋出之錯誤修補（Patches）與功能更新（Updates）。
- 1.1.2 第三方軟體、第三方驅動程式、作業系統及硬體本身，均非本軟體。
- 1.1.3 本軟體僅透過本公司官方網站、經本公司正式公告之下載管道，或其他經本公司明確授權之管道發布及提供。使用者應透過前述管道取得本軟體，並自行確認下載來源之合法性及正確性。
- 1.1.4 未經本公司事前書面同意，任何人不得將本軟體全部或一部，以任何形式或透過任何管道，擅自重製、上傳、發布、轉載、散布、提供下載、轉交或以其他方式提供予第三人，包括但不限於第三方網站、檔案分享平台、雲端儲存空間、論壇、社群平台或其他網路服務。
- 1.1.5 使用者不得以本公司未經授權之第三方網站、下載連結或其他來源所提供之本軟體，主張該等來源已獲本公司認可或授權。本公司亦不因第三方擅自發布或提供本軟體，而對該等第三方之發布行為、檔案完整性、安全性或內容正確性負責。
1.2 授權性質：
- 1.2.1 本公司依本合約條款授予使用者一項非專屬、不可轉讓及不可再授權之本軟體使用權，僅得於使用者所持有或合法控制之相容運算設備上，依本合約之約定使用本軟體。
- 1.2.2 前項授權不涉及本軟體或其相關智慧財產權之讓與，除本合約明確授予之權利外，本軟體之一切權利均為本公司所有。
- 1.2.3 本公司得依本合約之約定終止或限制使用者之使用權限。
1.3 版本與授權方式：
- 1.3.1 免費版（Free / Standard Edition）：本公司得免費提供本軟體予使用者使用。免費版之使用，除應遵守本合約所定使用條件外，本公司得為提供本軟體功能、進行效能分析、服務維護及改善，以及建置及維護公開排行榜之目的，蒐集、處理及利用使用者使用本軟體所產生之相關資料。涉及個人資料者，其蒐集、處理及利用之目的、資料類別、期間、地區、對象、方式及使用者依法得行使之權利，依本公司另行提供之「個人資料告知事項及隱私權政策」辦理。
- 1.3.2 企業版（Enterprise Edition）：本公司得另行推出企業版或其他商業版本。企業版之授權、費用、服務等級、資料處理及其他商業條件，應另行簽訂商業合約。
第二條 智慧財產權
2.1 本軟體及其相關內容，包括但不限於程式碼、程式架構、評測演算法、測試方法、運算權重、資料結構、使用者介面、視覺設計、圖像、文字、及其他相關內容之智慧財產權，均為本公司所有。使用者依本合約僅有本軟體之使用權，不因此取得本軟體之所有權或其他智慧財產權。
2.2 「Anrotec」、「AnroMark」及本公司其他商標、標誌或產品名稱，使用者均不得未經本公司事前書面同意而使用。
第三條 使用限制
3.1 使用者不得對本軟體進行反向工程、反向編譯、反組譯、解碼或其他足以取得本軟體原始碼、核心演算法或評測邏輯之行為，但法律明文允許且不得以契約排除或限制之行為，不在此限。
3.2 未經本公司事前書面同意，使用者不得修改、改編、拆解、出租、出借、再授權、散布、提供第三人下載、鏡像代管或代為提供本軟體之使用服務，亦不得將本軟體整體或部分提供予第三人作為收費測試、代測或其他商業服務之工具。
3.3 使用者不得以任何方式故意偽造、竄改、干擾或破壞測試結果、測試資料或本公司伺服器之正常運作，包括但不限於：
- 3.3.1 竄改記憶體、模擬或偽造硬體資訊，以不實方式影響測試結果；
- 3.3.2 攔截、竄改、偽造或重送本軟體向本公司伺服器傳送之資料；
- 3.3.3 以自動化程式大量產生、提交或重複提交測試資料，致影響排行榜之公平性或伺服器正常運作；
- 3.3.4 以其他足以實質影響測試結果、排行榜公平性或本公司服務正常運作之方式使用本軟體。
3.4 使用者設定之顯示名稱如涉及違法、侵害第三人權利、冒用他人身分、違反公序良俗或其他明顯不適當情形，本公司得通知使用者限期更正；情況急迫或有必要避免損害擴大者，本公司得先暫時將該顯示名稱變更為 Anonymous。
第四條 資料回傳
4.1 為提供測試結果、維護及改善本軟體服務，以及建置及維護「AnroMark 地端 AI 算力天梯圖（AnroMark Local AI Ladder）」，本軟體於使用者完成測試時，得依本條約定將測試所必要之硬體及系統資訊、測試結果及使用者設定之公開顯示名稱等資料，傳送至本公司位於臺灣之伺服器。使用者如不同意本項所定資料回傳機制，得選擇不安裝或停止使用具資料回傳功能之免費版；本公司得因此限制部分須依賴資料回傳始能提供之功能。
4.2 本公司蒐集之資料以提供本軟體服務、進行效能分析、維護及改善服務及建置排行榜所必要者為限，包括但不限於：
- 4.2.1 使用者設定之公開顯示名稱；
- 4.2.2 處理器、顯示晶片、神經網路處理器、記憶體、儲存媒體、主機板或晶片組、BIOS、作業系統及驅動程式等硬體及系統之型號、規格及版本資訊；
- 4.2.3 測試項目、測試耗時、延遲、吞吐量、測試結果及時間戳記；
- 4.2.4 為判斷資料來源地區，自使用者連線推導之地區代碼（本公司不保留使用者之 IP 位址）；
- 4.2.5 使用者註冊帳號時提供之電子郵件信箱。
4.3 本公司不得蒐集或回傳與前項目的無關之使用者檔案內容、檔案路徑、密碼、通訊內容、處理器序號、主機板識別碼、網路卡實體位址、儲存裝置序號或其他裝置唯一識別碼，或其他非測試服務所必要之個人資料。
4.4 本公司就使用者所提供或本軟體於使用過程中取得之個人資料，應依個人資料保護法及相關法令辦理。涉及個人資料之蒐集、處理及利用，其目的、資料類別、利用期間、地區、對象、方式及使用者依法得行使之權利等事項，依本公司另行提供之「個人資料告知事項及隱私權政策」辦理。
4.5 排行榜公開：
- 4.5.1 為建置及維護「AnroMark 地端 AI 算力天梯圖（AnroMark Local AI Ladder）」，本公司得於本公司官方網站、排行榜、社群平台、評測報告或其他公開資訊中，公開展示測試結果及與該測試結果相關之必要測試資訊。使用者於同意畫面填寫公開顯示名稱者，本公司得以該公開顯示名稱展示其測試結果；使用者未填寫公開顯示名稱，或選擇不公開顯示名稱者，測試結果以「Anonymous」名義展示。涉及個人資料之蒐集、處理及利用者，依本公司「個人資料告知事項及隱私權政策」辦理。
- 4.5.2 使用者設定公開顯示名稱時，應自行確認該名稱不含真實姓名、身分證字號、聯絡方式或其他足以直接或間接識別特定個人之資訊，亦不得侵害第三人之姓名、商標、著作權或其他權利。
- 4.5.3 使用者得依本公司所提供之方式，隨時撤回以公開顯示名稱展示測試結果之同意。本公司於確認申請後，將於三十日內改以「Anonymous」名義展示或停止後續公開展示；但撤回前已合法製作、發布之統計資料、彙整資料、歷史排行榜、出版品或其他已完成之公開內容，本公司得於法令允許範圍內繼續保留及使用。
4.6 本公司得基於測試規範、資料完整性、系統安全性及排行榜公平性之必要，對蒐集之資料進行驗證、比對、標記、排除或調整其於排行榜之呈現方式。
4.7 如資料經本公司依合理之技術標準判斷具有異常、重複、竄改、疑似不當取得或其他足以影響排行榜公平性之情形，本公司得將該測試結果標示為未驗證或非標準測試，或不納入排行榜計算；必要時，並得移除該筆排行榜資料。
第五條 技術規範
5.1 本軟體各項測試模組於執行前，得於介面上明確載明標準測試前置條件、硬體設定建議與操作警示（以下統稱「評測指引」），並提供可供測試使用之 AI 模型清單（以下稱「指定模型清單」）。該等評測指引及指定模型清單係本軟體測試結果判定及排行榜收錄之重要依據，使用者應依評測指引所載條件及方式，並以指定模型清單所列之模型進行測試。
5.2 如使用者未依本軟體之評測指引所定條件之環境下進行測試，包括但不限於使用電池供電、存在過高背景處理負載、散熱不良致引發嚴重熱降頻、超頻不穩定、或使用指定模型清單以外之模型，或測試結果經本公司依合理之技術標準判斷有異常、遭竄改或不足以作為公平比較之依據，本公司得將該筆資料標示為「非標準測試（Unverified / Non-Standard Run）」、逕行判定為無效成績，或不納入 AnroMark 地端 AI 算力天梯圖之排行榜。
第六條 公開引用
6.1 使用者公開引用、發布或展示本軟體之測試結果時，應以真實、完整且足以避免誤導之方式呈現，不得擅自修改、截取或重新製作足以改變原測試結果意義之資料。使用者如以工程樣品（Engineering Sample, ES）、特別挑選之樣品（Golden Sample）或其他非一般市售規格之硬體進行測試，於公開引用、發布或展示測試結果時，應以足以使一般第三人知悉之方式揭露該受測樣品之性質及重要測試條件，不得使第三人誤認該測試結果係以一般市售產品所取得。
6.2 公開引用測試結果時，應於合理且在足以使一般第三人知悉之範圍內揭露受測硬體之主要規格及影響測試結果之重要測試條件，包括但不限於受測硬體之完整規格、散熱設定、功耗限制（TDP/TGP）、BIOS 版本、系統電源計畫及驅動程式版本號碼，實際揭露項目得依測試模組及發布內容之性質調整。
6.3 未獲本公司事前書面核准，任何人不得使用「安容官方認證最佳硬體」、「Anrotec 指定標準平台」等具背書性質之文字進行商品行銷。
6.4 如公開發布內容明顯違反本條約定，且足以造成第三人誤認測試結果、損害本公司權益或影響排行榜公信力，本公司得通知發布者於 48 小時內更正、補充說明或下架；如涉及侵害本公司或第三人權利之情形，本公司並得依法請求相關救濟。
第七條 免責聲明
7.1 本軟體係依其現有狀態提供，本公司於合理範圍內維持本軟體之正常運作，但不保證本軟體於所有設備、作業系統或使用環境均可正常運作，亦不保證測試結果不受硬體、驅動程式、作業系統、韌體、環境條件或其他第三方因素影響。本軟體所產生之測試結果，僅反映特定硬體及測試條件下之效能表現，不構成對受測硬體之品質、可靠性、安全性、耐久性、適用性或其他產品特性之保證或認證。
7.2 使用者知悉本軟體包含高負載運算、極限壓力檢測及硬體穩定度測試模組，可能使受測設備處於高負載或高運算量狀態。使用者應於執行測試前確認設備之硬體狀況、散熱狀況、供電穩定性、零件耐受度及其他使用條件。
7.3 如因受測設備本身存在硬體瑕疵、老化、散熱異常、供電異常、超頻、電壓調整、使用者操作不當，或其他非可歸責於本公司之因素，致測試過程中發生元件過熱、降頻、當機、資料遺失、硬體損壞或其他異常狀況，本公司不負賠償責任。
第八條 責任限制
8.1 本公司對於因使用或無法使用本軟體所生之間接、附隨、特殊或衍生性損害，以及所失利益、營業中斷或資料損失，不負賠償責任。
8.2 鑑於本軟體係以免費形式授權提供，除法律另有強制規定或本公司依法不得限制或免除責任之情形外，本公司就本合約所負之損害賠償責任，於任何情況下均以使用者實際支付予本公司之本軟體相關費用為上限；如使用者係免費使用本軟體，則本公司於本合約下之全部累積損害賠償責任上限為新臺幣零元（NT$ 0）。
第九條 違反效果及合約終止
9.1 使用者重大違反本合約約定者，本公司得以書面、電子郵件或軟體介面通知使用者限期改善；如使用者之違約情形無法補正、屆期仍未改善，或涉及偽造、竄改或不當操控測試資料、惡意攻擊或干擾本公司系統、冒用或侵害第三人權利之顯示名稱、未經授權提供本軟體予第三人使用、違反本合約所定公開引用規範，或有立即防止損害擴大之必要者，本公司得不經催告立即暫停全部或部分功能、移除相關排行榜資料或終止本合約，並下架該使用者於天梯圖上之所有歷史成績。
9.2 本合約終止後，使用者應停止使用本軟體並刪除其所持有之本軟體及相關安裝檔案。
第十條 準據法與管轄法院
10.1 本合約之訂立、效力、解釋、履行及爭端解決，均以中華民國（臺灣）法律為準據法。
10.2 因本合約所生之爭議，雙方合意以臺灣臺北地方法院為第一審管轄法院。
第十一條 一般條款
11.1 本軟體可能包含或使用第三方軟體、開放原始碼軟體或其他第三方元件（以下統稱「第三方元件」）。第三方元件之授權條件，應依其適用之授權條款辦理。
11.2 本合約構成雙方就本軟體授權之完整協議，取代先前所有口頭或書面之通訊或協議。
11.3 本公司得因法令變更、服務內容調整、資訊安全需求、技術更新或其他合理事由修改本合約。涉及使用者重要權利義務之重大變更者，本公司應以適當方式提前通知使用者，並於合理期間內提供使用者停止使用本軟體之選擇。使用者於變更生效後繼續使用本軟體者，視為同意修改後之條款。
11.4 前項所稱重大變更，包括但不限於擴大資料蒐集或利用範圍、增加使用者主要義務、限制使用者既有權利，或對本軟體主要功能、授權條件或責任限制產生重大影響之變更。
11.5 第三方模型：使用者為執行測試而自行選擇、下載或安裝之 AI 模型（以下稱「第三方模型」），係由各該模型之權利人依其授權條款提供，非本軟體之一部分。使用者應自行確認並遵守第三方模型之授權條款及使用限制。本公司不對第三方模型之內容、品質、可用性或授權適法性負責。
11.6 自動更新：本軟體得自動檢查、下載及安裝錯誤修補與功能更新。使用者安裝本軟體即同意接受該等更新。
11.7 可分性：本合約任一條款如經有管轄權之法院認定無效或不可執行，不影響其他條款之效力。
IMPORTANT NOTICE: PLEASE READ CAREFULLY BEFORE INSTALLING, ACTIVATING, OR USING THE SOFTWARE
This Software End User License Agreement (this "Agreement") is an agreement between the user (an individual, technology media outlet, research institution, or single legal entity, collectively referred to as "you" or the "User") and Anrotec Inc. ("Anrotec") governing the use of the AnroMark Local AI Assessment Tool (the "Software"). By clicking "I Agree" or "Accept," checking the confirmation box, or installing, registering, copying, downloading, or running the Software after reading this Agreement, you acknowledge that you have read, understood, and agreed to be bound by this Agreement. If you do not agree to the terms of this Agreement, do not install, activate, or use the Software, and you must discontinue the installation process or delete any installed copies of the Software and related files. If you are using the Software on behalf of a legal entity, company, institution, or other organization, you represent and warrant that you have the authority to accept this Agreement on behalf of that legal entity, company, institution, or organization. The Software is provided by Anrotec from Taiwan and is intended solely for users located in Taiwan. It has not been marketed to or localized for any other country or region. If you use the Software outside Taiwan, you are solely responsible for confirming the legality of such use and for bearing any associated risks. The Software is available only to users who are at least eighteen (18) years of age. By clicking "I Agree," registering an account, or using the Software, you represent and warrant that you are at least eighteen (18) years of age and that you are using the Software in Taiwan. If you are under eighteen (18) years of age, do not install, register for, or use the Software.
Article 1 Subject Matter and License
1.1 Definitions and Source:
- 1.1.1 As used in this Agreement, the "Software" means the AnroMark software and related content developed, released, or provided by Anrotec, including but not limited to hardware benchmark modules, system stress-load components, algorithm benchmarking scripts, the associated graphical user interface, the account/display name configuration mechanism, accompanying offline or online documentation, and any subsequently released bug fixes ("Patches") and feature updates ("Updates").
- 1.1.2 Third-party software, third-party drivers, operating systems, and the hardware itself are not part of the Software.
- 1.1.3 The Software is released and made available only through Anrotec's official website, download channels officially announced by Anrotec, or other channels expressly authorized by Anrotec. You shall obtain the Software through the foregoing channels and are responsible for verifying the legitimacy and authenticity of the download source.
- 1.1.4 Without Anrotec's prior written consent, no person may reproduce, upload, publish, repost, distribute, make available for download, transfer, or otherwise provide the Software, in whole or in part, in any form or through any channel, to any third party, including but not limited to third-party websites, file-sharing platforms, cloud storage services, forums, social media platforms, or other online services.
- 1.1.5 You may not rely on copies of the Software offered by third-party websites, download links, or other sources not authorized by Anrotec to claim that such sources have been approved or authorized by Anrotec. Nor shall Anrotec, by reason of any third party's unauthorized publication or provision of the Software, be responsible for such third party's distribution activities or for the file integrity, security, or accuracy of content so distributed.
1.2 Nature of License:
- 1.2.1 Subject to the terms of this Agreement, Anrotec grants you a non-exclusive, non-transferable, and non-sublicensable license to use the Software solely on compatible computing devices that you own or lawfully control, in accordance with this Agreement.
- 1.2.2 The foregoing license does not constitute an assignment of the Software or any related intellectual property rights. Except for the rights expressly granted under this Agreement, all rights in and to the Software are owned by Anrotec.
- 1.2.3 Anrotec may terminate or restrict your license in accordance with this Agreement.
1.3 Editions and Licensing Models:
- 1.3.1 Free / Standard Edition: Anrotec may provide the Software to you free of charge. In addition to the conditions of use set forth in this Agreement, use of the Free Edition is subject to Anrotec's right to collect, process, and use the data generated by your use of the Software for the purposes of providing the Software's features, conducting performance analysis, maintaining and improving the service, and building and maintaining the public leaderboard. Where personal data is involved, the purposes, categories of data, period, territory, recipients, and methods of collection, processing, and use, as well as the rights you may exercise under applicable law, are governed by Anrotec's separately provided "Personal Data Notice and Privacy Policy."
- 1.3.2 Enterprise Edition: Anrotec may separately offer an Enterprise Edition or other commercial editions. The licensing, fees, service levels, data processing, and other commercial terms of the Enterprise Edition shall be set forth in a separate commercial agreement.
Article 2 Intellectual Property Rights
2.1 All intellectual property rights in the Software and its related content, including but not limited to the program code, program architecture, benchmark algorithms, testing methodologies, computational weightings, data structures, user interface, visual design, images, text, and other related content, are owned by Anrotec. Under this Agreement, you receive only a license to use the Software and do not thereby acquire ownership of, or any other intellectual property rights in, the Software.
2.2 You may not use "Anrotec," "AnroMark," or any other trademarks, logos, or product names of Anrotec without Anrotec's prior written consent.
Article 3 Restrictions on Use
3.1 You may not reverse engineer, decompile, disassemble, or decode the Software, or engage in any other activity that could yield the Software's source code, core algorithms, or benchmark logic, except to the extent such activity is expressly permitted by law and cannot be excluded or limited by contract.
3.2 Without Anrotec's prior written consent, you may not modify, adapt, dismantle, rent, lend, sublicense, distribute, make available for download to third parties, mirror or host the Software, or provide access to the Software as a service on behalf of others, nor may you provide the Software, in whole or in part, to any third party as a tool for paid testing, testing-for-hire, or other commercial services.
3.3 You may not, by any means, intentionally falsify, tamper with, interfere with, or disrupt test results, test data, or the normal operation of Anrotec's servers, including but not limited to:
- 3.3.1 tampering with memory, or simulating or falsifying hardware information, so as to improperly influence test results;
- 3.3.2 intercepting, tampering with, falsifying, or replaying data transmitted by the Software to Anrotec's servers;
- 3.3.3 using automated programs to generate, submit, or repeatedly submit test data in bulk in a manner that affects the fairness of the leaderboard or the normal operation of the servers; or
- 3.3.4 using the Software in any other manner that could materially affect test results, the fairness of the leaderboard, or the normal operation of Anrotec's services.
3.4 If a display name you set is unlawful, infringes the rights of a third party, impersonates another person, violates public order or good morals, or is otherwise clearly inappropriate, Anrotec may notify you to correct it within a specified period. Where the situation is urgent or it is necessary to prevent further harm, Anrotec may first temporarily change the display name to "Anonymous."
Article 4 Data Transmission
4.1 To deliver test results, maintain and improve the Software and its services, and build and maintain the "AnroMark Local AI Ladder," the Software may, upon your completion of a test and in accordance with this Article, transmit data including the hardware and system information necessary for the test, the test results, and the public display name you have set (the "Public Display Name") to Anrotec's servers located in Taiwan. If you do not agree to the data transmission mechanism described in this Section, you may choose not to install, or to stop using, the Free Edition with data transmission functionality; Anrotec may accordingly restrict certain features that can only be provided in reliance on data transmission.
4.2 The data collected by Anrotec is limited to what is necessary to provide the Software's services, perform performance analysis, maintain and improve the services, and build the leaderboard, including but not limited to:
- 4.2.1 the Public Display Name you have set;
- 4.2.2 the model, specification, and version information of hardware and system components such as the processor, graphics processor, neural processing unit, memory, storage media, motherboard or chipset, BIOS, operating system, and drivers;
- 4.2.3 test items, test duration, latency, throughput, test results, and timestamps;
- 4.2.4 a region code derived from your connection for the purpose of determining the geographic origin of the data (Anrotec does not retain your IP address); and
- 4.2.5 the email address you provide when registering an account.
4.3 Anrotec shall not collect or transmit, where unrelated to the purposes described in the preceding Section, any user file contents, file paths, passwords, communication contents, processor serial numbers, motherboard identifiers, network adapter physical (MAC) addresses, storage device serial numbers, or other unique device identifiers, or any other personal data not necessary for the benchmarking service.
4.4 Anrotec shall handle personal data that you provide or that the Software obtains in the course of use in accordance with the Personal Data Protection Act of Taiwan and related laws and regulations. Where the collection, processing, and use of personal data is involved, the purposes, categories of data, period, territory, recipients, and methods of use, as well as the rights you may exercise under applicable law, are governed by Anrotec's separately provided "Personal Data Notice and Privacy Policy."
4.5 Leaderboard Publication:
- 4.5.1 To build and maintain the "AnroMark Local AI Ladder," Anrotec may publicly display test results and the necessary test information related to those results on Anrotec's official website, the leaderboard, social media platforms, benchmark reports, or other public materials. Where you have entered a Public Display Name on the consent screen, Anrotec may display your test results under that Public Display Name; where you have not entered a Public Display Name, or have elected not to have it displayed, test results will be displayed under the name "Anonymous." Where the collection, processing, and use of personal data is involved, Anrotec's "Personal Data Notice and Privacy Policy" applies.
- 4.5.2 When setting a Public Display Name, you are responsible for ensuring that the name does not contain a real name, national ID number, contact information, or other information that could directly or indirectly identify a specific individual, and that it does not infringe any third party's name, trademark, copyright, or other rights.
- 4.5.3 You may withdraw your consent to the display of test results under your Public Display Name at any time by the means provided by Anrotec. Within thirty (30) days after confirming your request, Anrotec will display the results under the name "Anonymous" or cease further public display; provided, however, that Anrotec may, to the extent permitted by law, continue to retain and use any statistics, aggregated data, historical leaderboards, publications, or other completed public content that was lawfully created and published before the withdrawal.
4.6 Anrotec may, as necessary for benchmark standards, data integrity, system security, and leaderboard fairness, verify, cross-check, flag, or exclude collected data, or adjust the manner in which it is presented on the leaderboard.
4.7 If Anrotec determines, based on reasonable technical standards, that data is anomalous, duplicated, tampered with, suspected of having been improperly obtained, or otherwise likely to affect the fairness of the leaderboard, Anrotec may mark the test result as unverified or non-standard, or exclude it from leaderboard calculations, and, where necessary, remove the leaderboard entry.
Article 5 Technical Specifications
5.1 Before each test module of the Software is run, the Software may clearly set out in its interface the standard pre-test conditions, recommended hardware settings, and operational warnings (collectively, the "Benchmark Guidelines") and provide a list of AI models available for testing (the "Designated Model List"). The Benchmark Guidelines and the Designated Model List are the key basis on which the Software's test results are evaluated and admitted to the leaderboard. You shall conduct tests under the conditions and in the manner set forth in the Benchmark Guidelines and using the models on the Designated Model List.
5.2 If you conduct a test in an environment that does not meet the conditions set forth in the Software's Benchmark Guidelines, including but not limited to running on battery power, excessive background processing load, inadequate cooling resulting in severe thermal throttling, unstable overclocking, or use of a model not on the Designated Model List, or if Anrotec determines, based on reasonable technical standards, that a test result is anomalous, has been tampered with, or is insufficient to serve as a basis for fair comparison, Anrotec may mark the entry as an "Unverified / Non-Standard Run," deem it an invalid result outright, or exclude it from the AnroMark Local AI Ladder.
Article 6 Public Citation
6.1 When publicly citing, publishing, or displaying test results generated by the Software, you shall present them in a truthful, complete, and non-misleading manner, and shall not modify, excerpt, or recreate data in a way that alters the meaning of the original test results. If you conduct tests using an Engineering Sample (ES), a specially selected sample (Golden Sample), or other hardware with non-retail specifications, you shall, when publicly citing, publishing, or displaying the test results, disclose the nature of the tested sample and the material test conditions in a manner sufficient to inform an ordinary third party, and shall not cause third parties to mistakenly believe that the test results were obtained using generally available retail products.
6.2 When publicly citing test results, you shall disclose, to a reasonable extent sufficient to inform an ordinary third party, the principal specifications of the tested hardware and the material test conditions affecting the results, including but not limited to the complete specifications of the tested hardware, cooling configuration, power limits (TDP/TGP), BIOS version, system power plan, and driver version numbers. The specific items disclosed may be adjusted according to the nature of the test module and the published content.
6.3 Without Anrotec's prior written approval, no person may use endorsement-type language such as "Anrotec Officially Certified Best Hardware" or "Anrotec Designated Standard Platform" in product marketing.
6.4 If published content clearly violates this Article and is likely to mislead third parties as to the test results, harm Anrotec's rights or interests, or undermine the credibility of the leaderboard, Anrotec may notify the publisher to, within forty-eight (48) hours, correct the content, provide a supplementary explanation, or take down the content. Where the rights of Anrotec or any third party are infringed, Anrotec may also seek relief in accordance with the law.
Article 7 Disclaimer
7.1 The Software is provided "as is." Anrotec will, to a reasonable extent, maintain the normal operation of the Software, but does not warrant that the Software will operate properly on all devices, operating systems, or environments, nor that test results will be unaffected by hardware, drivers, operating systems, firmware, environmental conditions, or other third-party factors. Test results generated by the Software reflect only the performance of specific hardware under specific test conditions and do not constitute a warranty or certification of the quality, reliability, safety, durability, suitability, or other product characteristics of the tested hardware.
7.2 You acknowledge that the Software includes high-load computation, extreme stress testing, and hardware stability testing modules that may place the tested device under high load or intensive computation. Before running a test, you shall confirm the hardware condition, cooling condition, power supply stability, component tolerances, and other operating conditions of the device.
7.3 Anrotec shall not be liable for damages if, during testing, component overheating, throttling, crashes, data loss, hardware damage, or other abnormal conditions occur as a result of hardware defects in the tested device, aging, abnormal cooling, abnormal power supply, overclocking, voltage adjustments, improper operation by you, or other factors not attributable to Anrotec.
Article 8 Limitation of Liability
8.1 Anrotec shall not be liable for any indirect, incidental, special, or consequential damages, or for lost profits, business interruption, or loss of data, arising out of the use of or inability to use the Software.
8.2 Given that the Software is licensed free of charge, and except as otherwise mandated by law or where Anrotec may not lawfully limit or exclude its liability, Anrotec's liability for damages under this Agreement shall in no event exceed the fees you actually paid to Anrotec for the Software. If you use the Software free of charge, Anrotec's total aggregate liability for damages under this Agreement shall be capped at zero New Taiwan Dollars (NT$0).
Article 9 Consequences of Breach and Termination
9.1 If you materially breach this Agreement, Anrotec may notify you in writing, by email, or through the Software interface to cure the breach within a specified period. If the breach cannot be cured or is not cured within the specified period, or if it involves the falsification, tampering with, or improper manipulation of test data; malicious attacks on or interference with Anrotec's systems; a display name that impersonates another person or infringes the rights of a third party; unauthorized provision of the Software to third parties; or violation of the public citation rules set forth in this Agreement, or where immediate action is necessary to prevent further harm, Anrotec may, without prior demand, immediately suspend all or part of the Software's functionality, remove the relevant leaderboard data, or terminate this Agreement, and remove all of your historical results from the AnroMark Local AI Ladder.
9.2 Upon termination of this Agreement, you shall cease using the Software and delete all copies of the Software and related installation files in your possession.
Article 10 Governing Law and Jurisdiction
10.1 The formation, validity, interpretation, performance, and dispute resolution of this Agreement shall be governed by the laws of the Republic of China (Taiwan).
10.2 For any dispute arising out of this Agreement, the parties agree that the Taiwan Taipei District Court shall have jurisdiction as the court of first instance.
Article 11 General Provisions
11.1 The Software may contain or use third-party software, open-source software, or other third-party components (collectively, "Third-Party Components"). The licensing conditions of Third-Party Components are governed by their applicable license terms.
11.2 This Agreement constitutes the entire agreement between the parties regarding the licensing of the Software and supersedes all prior oral or written communications or agreements.
11.3 Anrotec may amend this Agreement due to changes in law, adjustments to service content, information security requirements, technology updates, or other reasonable grounds. For material changes affecting your important rights and obligations, Anrotec shall notify you in advance by appropriate means and provide you, within a reasonable period, with the option to stop using the Software. If you continue to use the Software after the changes take effect, you will be deemed to have agreed to the amended terms.
11.4 "Material changes" as referred to in the preceding Section include, but are not limited to, expanding the scope of data collection or use, imposing additional principal obligations on you, restricting your existing rights, or changes that materially affect the Software's principal functions, licensing conditions, or limitation of liability.
11.5 Third-Party Models: Any AI model that you select, download, or install to run a test (a "Third-Party Model") is provided by its respective rights holder under its own license terms and does not form part of the Software. You are solely responsible for reviewing and complying with the license terms and use restrictions of any Third-Party Model. Anrotec is not responsible for the content, quality, availability, or lawfulness of the licensing of any Third-Party Model.
11.6 Automatic Updates: The Software may automatically check for, download, and install Patches and Updates. By installing the Software, you agree to receive such updates.
11.7 Severability: If any provision of this Agreement is held invalid or unenforceable by a court of competent jurisdiction, the validity of the remaining provisions shall not be affected.
